Welcome to ASHNOER TECHNOLOGY PRIVATE LIMITED (“Kapisa”, “we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Kapisa App, the QR Safety System, Vehicle QR, AI Recognition Services, and all related features (“Services”).
By downloading, accessing, or using the App or Services, you agree to these Terms. If you do not agree, please discontinue use immediately.
1. Eligibility
You must:
- Be at least 18 years old to create an adult profile.
- Be a verified parent or legal guardian to create a child/infant profile
- Provide accurate information during registration.
Kapisa reserves the right to suspend or terminate accounts with false or incomplete information.
2. User Account & Registration
To use our Services, you must:
- Register using a valid mobile number.
- Verify your identity via OTP
- Accept our Privacy Policy and Terms.
For features like AI Recognition, additional verification (Aadhaar OTP, SSM iD, alternate KYC) may be required.
You are responsible for maintaining the confidentiality of your account and OTP access.
3. QR-Based Identification Services
Kapisa provides QR codes for
- Personal Safety (individual identification)
- Vehicle Safety (parking, accident, emergency alerts)
By activating a QR code, you acknowledge:
- The QR code may be scanned by third parties in emergencies.
- Your emergency contacts may be notified automatically.
- QR scans are logged to improve safety and audit incidents.
4. AI Recognition Services (Phase 2)
These services include:
- Face Recognition to identify individuals
- OCR/ANPR to identify vehicles by license plate
By opting into AI Recognition:
- You consent to providing your photo(s) and identity attributes.
- You consent to processing of your facial embedding for emergency identification.
- You understand that third-party helpers may upload images for identification purposes.
- Kapisa will only use this feature for safety and emergency response
Raw images are deleted automatically; only encrypted embeddings are stored.
5. Child Safety Profiles
Parents/guardians creating a child profile agree that:
- They have legal rights to provide this information
- Child photos and identifiers will be used solely for emergency identification.
- Alternate KYC such as SSM iD, Birth Certificate, School ID, or Hospital Card may be used for verification.
- Child data is stored securely and processed only with parental consent.
6. Emergency Contact Notifications
When QR codes or AI Recognition features are triggered, the system may:
- Notify emergency contacts instantly
- Share helper-provided information (location, messages, image)
- Reveal masked or consent-based contact numbers
Raw images are deleted automatically; only encrypted embeddings are stored.
7. Image Capture & Uploads
Helpers or users may upload images for:
- Identifying individuals in distress
- Identifying vehicles in emergency situations
By using this feature, you acknowledge:
- Images will be processed securely
- Images may be shared with emergency contacts
- Images will be deleted after their intended emergency use
- Misuse of image uploads (harassment, stalking, false reporting) is strictly prohibited
Kapisa monitors and logs abusive behavior and may suspend accounts.
8. User Obligations
You agree to:
- Provide true, current, and complete information
- Not misuse QR codes, AI recognition, or emergency features
- Not upload inappropriate or harmful content
- Not attempt to reverse engineer, copy, or misuse our technology
- Not impersonate another user
- Use the Services only for lawful and ethical purposes
Violations may result in account termination or legal action.
9. Prohibited Activities
You may NOT:
- Use Kapisa for harassment or stalking
- Trigger false emergency alerts
- Use third-party images without permission (outside emergencies)
- Access the platform using bots, crawlers, or scrapers
- Decompile or tamper with the App
- Sell or resell Kapisa QR codes without authorization
- Upload explicit, violent, or unlawful content
10. Intellectual Property
All copyrights, trademarks, logos, UI elements, and proprietary algorithms belong exclusively to ASHNOER TECHNOLOGY PRIVATE LIMITED
Users may not copy, modify, distribute, or reproduce any content without prior written consent.
11. Limitations of Liability
Kapisa provides its Services on an as-is and as-available basis.
We are not liable for:
- Actions or inactions of emergency contacts
- Delays in emergency responses
- AI recognition inaccuracies or false matches
- Damage or loss resulting from third-party misuse
- Network or device failures affecting notifications
- Incorrect data provided by users
- Misuse by helpers or unknown third parties
Kapisa is a supporting safety platform, not a replacement for emergency services or medical assistance.
12. Disclaimer
Kapisa is NOT an emergency service provider.
We do not guarantee:
- Response time from emergency contacts
- Successful identification in all conditions
- Accuracy of image-based recognition
The Platform assists in emergencies but cannot replace law enforcement, healthcare professionals, or certified rescue services.
13. Modifications to the Service
Kapisa reserves the right to:
- Change or discontinue any feature
- Introduce paid or premium features
- Suspend access temporarily for updates or maintenance
Users will be notified wherever possible.
14. Termination of Account
Kapisa may terminate or suspend access if:
- There is suspected misuse
- Fraudulent information is provided
- Child safety rules are violated
- User breaches Terms or violates law
Users may request account deletion at any time
15. Third-Party Services
Kapisa may integrate with:
- SMS/OTP providers
- Cloud hosting services
- Map/location APIs
- OCR/AI recognition tools
These providers have access only as necessary and are bound by confidentiality.
16. Changes to These Terms
We may update these Terms periodically. Updates take effect immediately upon posting in the App. Continued use signifies acceptance of revised Terms.
17. Governing Law
These Terms are governed by the laws of India. Disputes are subject to jurisdiction of courts located in Delhi NCR, unless specified otherwise
